Hi,
I am a Nepali student in USA. I fell in love with a nepali gal who is also in USA on a visitor visa but the visa is expired by over 180 days. I plan to marry her soon. Can anyone suggest how can I adjust her visa as my spouse without a need for her to go Nepal? Would her overstay would affect my greencard which i am planning to apply for one soon. thank you for your advice.

Rolex,

If I were you, I'd go back to Nepal (with her), get married there, and ask her to apply for a US visa there. You can bring your spouse to the US on an F2 visa if you're on an F1 visa.

How are you going to apply for a Green Card if you're a student? As far as I know, you can apply for a Green Card only through your employer or through a relative.

I am looking for a possibility of adjustment of status. If she returns nepal she won't be able to be back for the next few years. The greencard will be through my prospective employer.

Rolex bro,

Looks like you need some legal advice. Check out this Nepali immigration lawyer based in New York. He might be able to help you out:
